Course Overview

The Contract Claims Management & Dispute Resolution Training Course equips contract, commercial, project, and legal professionals with the knowledge and practical skills needed to prevent, prepare, evaluate, negotiate, and resolve contractual claims and disputes efficiently and fairly. In government entities, ministries, public authorities, utilities, banks, construction and engineering organizations, service providers, and large corporations, claims for additional time and money are a normal part of complex contracts. How they are managed determines whether they are settled promptly on the basis of facts and entitlement, or escalate into lengthy and costly disputes that damage budgets, schedules, and relationships. Many organizations handle claims reactively. Notices may be issued late or not at all, contemporaneous records may be incomplete, claims may be submitted without clear entitlement, causation, or quantum, and responses may reject claims without proper analysis or accept them without sufficient scrutiny. Delay and disruption may be assessed using unsuitable methods, overlapping causes of delay may be ignored, and negotiations may stall because positions are not supported by evidence. When disputes arise, organizations may choose resolution routes that are slower or more expensive than necessary, or may be poorly prepared for adjudication or arbitration. This course provides a structured, practical approach to claims management and dispute resolution applicable across construction, engineering, supply, and service contracts, including contracts based on international standard forms such as FIDIC. Participants learn the nature and types of claims, the three pillars of every claim, namely entitlement, causation, and quantum, and the critical role of notices, time limits, and records. The program covers extension of time and delay claims, delay analysis methods and their appropriate use, including guidance from recognized industry protocols, concurrent delay, disruption and loss of productivity, prolongation and acceleration costs, variation and change claims, and methods for quantifying costs such as head office overheads. Participants learn how to prepare well-structured claims, evaluate and respond to claims from the other party, and negotiate settlements. The course then addresses dispute avoidance and the full range of dispute resolution methods, including negotiation, mediation, expert determination, dispute boards, adjudication, arbitration, and litigation, as well as selecting the right method, the role of expert witnesses, drafting effective dispute resolution clauses, and establishing claims governance and lessons learned processes. The course is delivered through an interactive, application-focused approach with case studies, claim preparation and evaluation exercises, delay analysis workshops, and negotiation and mediation role plays. Participants leave with a claims management procedure outline, a notice and records checklist, a claim preparation template, a claim evaluation checklist, a dispute resolution method selection guide, and a claims avoidance action plan for their contracts.

Who Should Attend

This course is designed for contract managers, contracts administrators, commercial managers, claims specialists, quantity surveyors, and cost engineers responsible for preparing, evaluating, or negotiating claims. It is also highly relevant for project managers, project directors, construction managers, planning and scheduling engineers, procurement professionals, and consulting engineers involved in contract administration, as well as legal advisors and in-house counsel who advise on contractual disputes. It is particularly valuable for professionals in ministries, government entities, and public authorities managing infrastructure, building, and service contracts; in utilities and developers managing capital projects; in contractors, subcontractors, and consultants delivering construction and engineering works; in banks and financial institutions financing projects or managing large service and technology contracts; and in organizations managing major supply and outsourcing agreements. Senior managers and decision makers who approve claim settlements and dispute strategies will also benefit from the course.

Learning Outcomes

  • By the end of the course, participants will be able to:
  • Explain why claims arise and how effective management reduces their number and impact.
  • Identify the key elements that every successful claim must demonstrate.
  • Issue timely and compliant notices and maintain records that support or defend claims.
  • Select and apply suitable delay analysis methods for different situations and data availability.
  • Assess the effect of concurrent delay and disruption on entitlement to time and money.
